I saw this over at The Gateway Pundit and I thought it was kind of funny for a couple of reasons. Number one, why would anyone do this, and two, how do you really prosecute this?
A Southwest Airlines pilot is being charged with a federal crime after committing a “lewd indecent act and obscene exposure” while he was flying a plane from Pennsylvania to Florida on August 10 last year.
The article goes on to say that “no flight attendants or passengers witnessed the incident.” Ok, so I assume that the other pilot blew the whistle. That is fine, but they are prosecuting him in the state of Maryland because he overflew federal property there. Do they have to prove that he was hanging out while over Maryland? Are there photos that include balls and GPS coordinates?
Still, the government is claiming that this is illegal because it happened in a public place, over federal property. The flight deck (used to called the cock pit) is closed and locked to passengers, and another aircraft getting close enough to see the twig and berries would be a stretch (see what I did), so beyond just offending the other pilot, its kind of hard (and again) to see the crime. I’m not a lawyer though.
